Purpose of the App 

Health Storylines™ is available on the app stores of mobile and web-based platforms and is designed to help User maintain a healthy lifestyle through better tracking and management of their health produced in Clinical Trials. Health Storylines™ allows users to improve their experience in Clinical Trials, Registries and Patient support programs they are enrolled in, whilst also ensuring better data quality. The collected and shared clinical data allows Professional Users to understand the state of health of users involved in Clinical Trials. 

Health Storylines™ is, and must be exclusively used as, a tool for sharing clinical data. For this reason, Alira Health can in no way be held liable for dealings between Professional Users and Patients. 

Health Storylines™ is not a diagnostic tool or an automatic treatment tool for any pathology.  Health Storylines™ is provided to patients to collect information and clinical data relating to the state of their health whilst they participate in a Clinical Trial, registry or Patient support program. 

Health Storylines™ is not a substitute for consultation with, or diagnosis or treatment by, a qualified medical professional, whom users should contact if they have doubts regarding their state of health. 

Ownership of the App  

The Health Storylines™ application is protected by copyright and may not be reproduced or used without the expressed written permission of Alira Health Inc. Individuals or persons using Health Storylines™ (Users) may use Health Storylines™ application on all Android, iOS, handheld smartphones, tablets and web-based computing devices only for personal use. The software in its entirety is protected by copyright laws. The software also contains trade secrets and Users may not decompile, reverse engineer, disassemble, or otherwise reduce the software to human-perceivable form or disable any functionality which limits the use of the software. The User may not modify, adapt, translate, rent or sublicense (including offering the software to third parties on an application service provider or time share basis), assign, loan, resell for profit, or distribute the software, discs or related materials or create derivative works based upon the software or any part thereof, without the express written permission of Alira Health 

Users may have been referred to the Health Storylines™ app by a health care provider or a third party, such as a pharmaceutical company. By signing up, the User agrees that Alira Health Inc. may use the User’s email address to send occasional updates about new features, developments and education information. Users can unsubscribe to any further emails from Alira Health unsubscribe link provided in each email. 

Conditions for using the App 

Use of the App is permitted only to users who are natural persons who downloaded the App, read the Privacy Notice, consented to personal data processing if required, and accepted these Terms of Use. 

User’s responsibility 

The user is responsible for the correct use of the App and for the information provided to Health Storylines™. Each user represents and warrants that the information provided in the App is true and correct. Alira Health reserves the unconditional right to delete the account and deny the Patient access to the App if the information is found to be inaccurate or false. Patients whose access to the App is blocked cannot create new accounts.  

Users may use the content in the Articles and Tools section of Health Storylines™ for personal use only connected to use of the App; they therefore cannot copy or share the content with third parties. 

If any disputes are brought against Alira Health by third parties concerning the Users’s data, content or alleged misconduct when using the App, the Patient will be held personally liable to the third parties and to Alira Health. 

Notice of Privacy Practices 

Health Storylines™ complies with the applicable privacy legislation. The Personal Data supplied by the user, including the questionnaires and/or PROs (Patient Reported Outcome), will be processed in accordance with applicable law as described in the Privacy notice accessible from https://www.healthstorylines.com/hsl-privacy-policy . 

If required, the user can consent to the processing of his/her personal data for the methods and purposes set out in the Privacy Notice by selecting this option during registration. Personal Data will be used only for the purposes set out in the Privacy Notice and in accordance with the authorizations granted. 

Further information regarding Personal Data processing is available in the Privacy Notice provided at the time of the user’s registration and can be viewed in the Support section of the App.

The Health Storylines™ Application Disclaimer 

The Health Storylines™ application is designed to help User maintain a healthy lifestyle through better tracking and management of their health. In this regard, Health Storylines™ application has no control over, and makes no representations or warranties, express or implied, regarding User’s or User’s healthcare provider(s)’ or third party(s) use of The Health Storylines™ application or the use or interpretation of any information stored on, generated by or received through the Health Storylines™ application. User is solely responsible for communicating any health-related information to (and receiving feedback from) User’s healthcare provider(s). The Health Storylines™ application does not provide its licensors access to data that can identify the User. Authorized individuals are usually limited to the User’s designated healthcare provider who has referred the User. 

User is solely responsible for reviewing and evaluating the accuracy and relevance of any information stored on, generated by or received through the Health Storylines™ application. Alira Health cannot and does not guarantee said accuracy. 

The Health Storylines™ application and any information stored on, generated by or received through the Health Storylines™ application, including personalized education based on data-mining of data, are not intended to be a substitute for professional medical advice, diagnosis, or treatment. always seek the advice of a physician or other qualified healthcare provider with any questions regarding a medical condition. never disregard professional medical advice or delay in seeking it because of something read or learned through the use of the Health Storylines™ application or any information stored on, generated by or received through the Health Storylines™ application. 

User acknowledges that Alira Health or its licensors, in their sole discretion, may from time to time make modifications to the Health Storylines™ application. Such modifications may require corresponding changes to be made in the User’s systems. Changes or failure to make timely changes by User may sever or effect User’s access to the Health Storylines™ application. Neither Alira Health shall be responsible for such effects, and neither Alira Health nor its licensors shall have any obligation to furnish any maintenance and support services with respect to the Health Storylines™ application. 

The Health Storylines™ application is intended for educational purposes only. This application is not intended to offer or replace professional medical advice. Please speak to your healthcare provider if you have any health concerns or questions. 

Data supplied by third parties 

Alira Health, in its capacity as Service Provider, neither controls nor manages information or data supplied by third parties and, therefore, third parties are solely responsible for the information and data they provide. 

Alira Health, in its capacity as Service Provider, offers no guarantees regarding the content in the Articles section of Health Storylines™ and assumes no responsibility in relation to the content. 

Alira Health is in no way responsible for the veracity or accuracy of data and information inserted by the Patient through the App. 

Health Disclaimer 

The Health Storylines™ application cannot cause damage or injuries to the Patient’s health if used in accordance with these Terms of Use. 

The information contained herein is provided for general education purposes only. Persons using the data within The Health Storylines™ application for medical purposes, should not rely solely on the accuracy of the data herein. While the data may be updated periodically, users should independently check other sources for the latest and most accurate information. 

The Health Storylines™ is not a substitute for consultation with, or diagnosis or treatment by, a qualified medical professional, whom the Patient should contact if he/she has any doubts regarding his/her state of health. It is important not to delay a request for a medical consultation, ignore a doctor’s advice, or to start or interrupt any kind of health treatment based on information provided in Health Storylines™. The Health Storylines™ application is supported by third party databases. Alira Health is not and cannot be held responsible for the accuracy or content of third-party data. 

If the User has been asked to participate in a clinical research trial with their healthcare provider(s) or a healthcare industry partner(s), a specific ‘Informed Consent’, may be provided for the User’s signature. 

Any and all liability arising directly or indirectly from the use of Health Storylines™ application is hereby disclaimed. The Health Storylines™ application is provided “as is” and without any warranty express or implied. 

Alira Health provides no guarantees and assumes no liability, within the limits of the law, for any direct or indirect damage (including, without limitation, damage from disruption of service or data loss) to the Patient from the use or impossibility to use the Service for reasons not directly attributable to Alira Health. 

Any other liability mandatory by law is limited to the Service, thus expressly excluding any liability for direct and/or indirect damage that is the consequence of the Patient’s or third parties’ misconduct, i.e., abusive access or use of data, including Personal Data. 

Limitations in providing the Service 

Alira Health reserves the right to amend, suspend or cancel, in whole or in part, the Service at any time, including without notice. 

Alira Health cannot be held liable for any damage resulting from a failure to provide the Service because of malfunctions or failures in electronic communication devices for reasons not attributable to Alira Health. Alira Health will notify the Patient through the App of any suspensions or cancellations of the Service. 

Term 

These Terms of use apply for the period the Patient uses the Service. 

Force majeure 

Alira Health is exempt from any liability for the failure or delay in fulfilling its obligations under these Terms of Use, or arising from the suspension of – or impossibility to access – the Service offered through Health Storylines™ due to force majeure events out of its reasonable and foreseeable control, including, but not limited to, national strikes, terrorist attacks, civil insurrections, fires, explosions, internet or electronic device (including mobile phone) malfunctions for any reason, blackouts, and calamities of an exceptional nature (“Force Majeure Events”). 

Upon occurrence of a Force Majeure Cause, Alira Health will promptly notify the Patient through the App. Alira Health’s fulfilment of its obligations under these Terms of Use will be suspended for the period of any Force Majeure Events. 

Partial Severability 

If any clauses of these Terms of Use are held to be invalid, illegal or unenforceable by law, competent authorities or court decisions, the remaining clauses will be unaffected. 

Governing law and jurisdiction 

The relationship between Alira Health and the Patient is governed by Canadian law. 

Without prejudice to any applicable laws, any disputes arising out of or in connection with these Terms and Conditions will be subject to the exclusive jurisdiction of the Court of Toronto.
